Welcome to GroupSwim. GroupSwim is a web-based service that allows groups and organizations to create community websites for online discussions, sharing information, and aggregating group data.

GroupSwim knows that you care how information about you is used and shared, and we appreciate your confidence that we will do so carefully and sensibly. That's why we created this Privacy Statement. This is our way of demonstrating to you our strong commitment to your privacy. It also serves as a way we can communicate with you about our information gathering and dissemination practices.

3. Collected Information

GroupSwim collects user submitted information such as name, email and password data to authenticate users, and to send notifications to those members relating to the GroupSwim service. This information is not shared to anyone and is used by GroupSwim so we can customize your experience and protect the security of your account. For certain services, such as our premium services, we also request credit card or other payment account information, which we maintain in encrypted form on secure servers. We may combine the information you submit under your account with information from other GroupSwim services or third parties in order to provide you with a better experience and to improve the quality of our services. For certain services, we may give you the opportunity to opt out of combining such information or the option to subscribe to a service that limits our ability to utilize your personal information as provided in this Privacy Policy.

4. Log information

GroupSwim also logs non-personally-identifiable information including IP address, profile information, referring/exit pages, date/time stamp, aggregate user data, and browser type, from users and visitors to the site and one or more cookies that may uniquely identify your browser. This data is used to manage the website, track usage and improve the website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP addresses are recorded for security and monitoring purposes.

5. Invitations and Other Communications to Non-Members

GroupSwim users can invite new members to their community sites by sending invitation emails via our automated invitation service. GroupSwim stores the email addresses that members provide so that the respondents may be added to the respective Group Site of the member sending the invitations. GroupSwim does not sell these email addresses or use them to send any other communication besides invitations.

6. Updating your Personal Information

When you use the GroupSwim service, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backups), or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

To ensure we are able to collect information correctly, we may utilize the assistance of a third party. But any such third party would not be permitted to use the information for commercial purposes. Other third parties, such as content providers, may also provide content on the Site but they are not permitted to collect any information nor does GroupSwim share user information with them. In fact, except as allowed in this Privacy Statement or pursuant to any other agreements you may have with us, we will not disclose the information you provided to third parties.

The Site may contain links to other web sites. Personal information that you provide to those sites may be sent to GroupSwim in order to deliver the service. It is the sole responsibility of the user to keep such information private and confidential and a requirement to use the Site. We also offer some of our services in connection with other web sites. The affiliated sites may have different privacy practices and we encourage you to read their privacy policies. In addition, GroupSwim may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of our search technology, customized content and advertising.

Ads appearing on this Web site may be delivered to users by GroupSwim or one of our Web advertising partners. Our Web advertising partners may set cookies. 10. Financial Information

We may require financial qualification, Internet verification and other billing information from you in order to set up and verify your account. This may require information such as your billing name and address, credit card number, or the number of users within your organization that will be using GroupSwim. Any financial or billing information we collect through the Site would be used only to check the qualifications of prospective customers and to bill for the GroupSwim service; GroupSwim would not use financial information for marketing or promotional purposes. We also want to let you know that GroupSwim may use a third-party intermediary to manage the credit card processing. This intermediary only serves as a link in the distribution chain, and would not be permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing.

11. How to Opt Out

GroupSwim members may modify or remove any of their personal information at any time by logging into their account and accessing your account settings. Users can opt out of being contacted by us, or by receiving such information from us at any time by sending an email to privacy@groupswim.com. Please note, any request for deleting or changing an account must come from the account you wish to change.

GroupSwim member accounts are secured by unique user names (display names) and user-created passwords and GroupSwim takes certain precautions to insure that member account information is kept private. We use reasonable measures to protect user information that is stored within our database, and we restrict access to member information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please note that we cannot guarantee the absolute security of member account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of member information at any time.

GroupSwim may offer premium or other payment-based services for by which an adult may acquire by using a credit card. If you are under 18, you may not use GroupSwim to purchase goods or services or subscribe to any payment-based services. In addition, no minor child may use GroupSwim in any manner without the express consent of their parents or guardians and only to the extent expressly authorized by GroupSwim for such use. Please be aware that whenever you voluntarily post public information, (for example, to a discussion, weblogs or any other public forum) that it can be accessed by the public and in turn be used by those people to send you unsolicited communications. Accordingly, parents and guardians are on notice and are warned to take every possible precaution to keep minors safe from harm or danger as a result of any use of this Site or of any other service or any use of the Internet.
